The Club Monaco x The Backseat Stylers Sweepstakes (the “Sweepstakes”) is open to legal U.S. residents and Canada residents (except residents of Quebec who are at least eighteen (18) years of age. Employees of The Backseat Stylers (“Sponsor”), Club Monaco, and their respective parent(s), affiliates, partners, subsidiaries, franchises, distributors, advertising and promotion agencies, and the immediate families and household members of each are prohibited from participating. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law and regulations.
How to enter: Sweepstakes begins at 12:00 AM Eastern Time (“ET”) on December 10, 2012 and ends at 11:59 PM ET on December 16, 2012 (the “Sweepstakes Period”). To enter, during the Sweepstakes Period, go to The Backseat Stylers (backseatstylers.com) contest page (hereinafter, referred to as the “Website”). Once at the Website, follow the instructions to enter. You will be directed to provide the following information: name and email address. Only one (1) entry per person/email address. Duplicate entries for a single individual will be void. All entries become the property of Sponsor and will not be acknowledged or returned. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail account. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. By entering you are providing your personal information to Sponsor and The Backseat Stylers.
Prize(s): One (1) grand prize winner will receive: one (1) $500 shopping spree. ARV of grand prize: $500. Winners are solely responsible for the payment of all federal, state and local taxes and all other expenses or costs relating to the prizes not expressly set forth above. Prize is non-transferable and no substitution by winner or cash equivalent is permitted. Sponsor reserves the right to substitute prize for one of equal or greater value.
Selection of Winner(s): The winner(s) will be selected in a random drawing conducted on or about December 19, 2012 from among all eligible entries received during the Sweepstakes Period. Drawing will be conducted by the Sponsor’s representatives, whose decisions are final and binding in all matters relating to this Sweepstakes. Winners will be notified by phone or e-mail on or about December 19, 2012, and will be given instructions on how to claim the prize. If the potential winner is a Canadian resident, the potential winner must first correctly answer, unaided, a time-limited mathematical skill testing question to obtain prize. In addition, winners may be required to sign and return an affidavit (or declaration if a resident of Canada) of eligibility and liability release (and, where permitted, a publicity release) within ten (10) days of notification or prize will be forfeited and awarded to an alternate winner. Odds of winning depend on the number of eligible entries received.
Release of Liability: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. No photocopied or mechanically reproduced entries are eligible. By participating, all entrants release Sponsor, The Backseat Stylers, and their respective parents, subsidiaries, affiliates, partners, employees, directors, and agents, including advertising agencies (“Released Parties”), from any and against any and all liability, including any injury, loss, or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize. In addition, entrants agree that Released Parties are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, entrants agree that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
Additional Rules: Sponsor is not responsible for: (i) printing or typographical errors in any sweepstakes-related materials; (ii) lost, late, incomplete, illegible, mutilated, misdirected entries or, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled transmissions or other errors of any kind, whether human, mechanical or electronic; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. Persons found tampering with or abusing any aspect of the Sweepstakes, or who Sponsor believes to be causing any malfunction, error, disruption, or damage will be disqualified. By participating in the Sweepstakes, you: (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) suspend, modify or terminate the Sweepstakes if Sponsors believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper play of the Sweepstakes. If Sweepstakes is terminated before the end date, Sponsor will determine the winners from all eligible entries received as of the termination date. Entry constitutes consent to the use of prize winner’s name, voice, picture and/or likeness without compensation for promotion purposes, unless prohibited by law.
